The submission of position details to Jobs in Asbestos constitutes an acceptance by the Advertiser of these terms and conditions in full.

In this document:

"Jobs in Asbestos", "we", "us", and "our" means the business known as Jobs in Asbestos, operated by Basevalley Ltd, Prospect House, 148 Lawrence Street, York. YO10 3EB.

"Advertiser", "you" and "your" means the individual, partnership, company or other entity placing advertising with Jobs in Asbestos.

"WL" means Web Listing.

"CWL" means Contract Job Listing.


2. Confidentiality

Contract pricing and other terms are commercially sensitive and confidential. Advertiser agrees not to divulge any details to third parties (other than its solicitors and auditors for bona fine purposes) under any circumstances (other than as may be required by the Courts) without specific written permission from Jobs in Asbestos.


3. Copyright

All vacancies submitted to Jobs in Asbestos are edited by us before being published by us. Copyright in the resulting vacancy posted on our site is and remains with us at all times. Genuine jobseekers enjoy a licence to copy and reproduce vacancies advertised by us and you also enjoy a licence to reproduce vacancies posted by us for internal purposes and for dealing with genuine job seekers but you are not permitted to copy or reproduce advertisements published by us (or to purport to authorise others to do so) for any other purpose without our specific prior approval in writing.


4. Submission and content of vacancy details

4.1 Delivery: Unless otherwise agreed in writing by Jobs in Asbestos, vacancy details must be transmitted to Jobs in Asbestos by email, using our specified format, and sent by email to jobs@jobsinasbestos.co.uk.

4.2 Multiple jobs: Vacancy submissions must relate to a single job or a requirement for multiple identical jobs. We reserve the right to refuse listings for multiple, non-identical vacancies.

4.3 Description length: Vacancy descriptions must not exceed 1,000 characters (WL), or 2,000 characters (CWL). We reserve the right to paraphrase or otherwise reduce submissions which in our judgment are excessive.


5. Legal and ethical requirements

Vacancy details must comply with all laws and ethical rules to which the Advertiser is subject. These include, but are not limited to, the following.

5.1 Genuine vacancy details: Vacancies advertised must be currently available and details verifiably accurate. Generic job listings cannot be accepted for publication.

5.2 Discrimination: Vacancy advertisements cannot discriminate on the basis of race, colour, nationality, ethnic or national origins, disability, marital status, or trade union membership (save to the extent specifically permitted in law).

5.3 Acknowledgement of applications: Direct contact must be made as soon as possible with all candidates who submit an application or CV in response to a vacancy advertisement.


6. Publication of vacancy details

6.1 Deadline and publishing period: Jobs received by the correct email address in accordance with clauses 4 and 5 before 3pm (WL) or 6pm (CWL) on any business day will be included in the next scheduled daily Joblist email, and will be listed on our web site by 8am the following business day. Details will remain on the site for fourteen (WL) days or 1 Calendar Month (CWL) (plus intervening weekends and English bank holidays).

6.2 Alterations and corrections: We make whatever amendments we consider appropriate or necessary in the course of editing all vacancies published on our site in order to maintain a high quality of presentation and to aid keyword searching by web site visitors. Editing of vacancy submissions will take place without prior consultation with the Advertiser.

6.3 Refusal to publish: Jobs in Asbestos, in the interests of maintaining the quality of its web site, reserves the right to refuse publication of vacancy submissions without providing any reason to Advertiser.


7. Advertising rates & minimum invoice

7.1 Vacancy listings: Vacancy listings will be charged at the prevailing WL or CWL listing rates (whichever is applicable), unless varied by a specific advertising agreement.

7.2 Contracted listings: Where the Advertiser has agreed to supply a maximum number of 10 vacancy listings each month and does not meet the agreed number during a particular month, the Advertiser is liable to pay in full for the agreed maximum number of listings.

7.3 Other advertising: Other services will be charged at rates agreed with the Advertiser.

7.4 VAT: VAT shall be charged to all Advertisers at the rate applicable.


8. Billing and payment terms

8.1 Terms: WL vacancy listings will not be published until payment is received by us in full. Ad-hoc and contracted Advertisers will be billed calendar monthly in arrears. Payment is due within 14 days of the invoice date unless otherwise agreed in advance of publication.

8.2 Late payments: We reserve the right to charge interest on late payments, calculated in accordance with the Late Payment of Commercial Debts (Interest) Act 1998, plus any costs of debt recovery including commissions paid to debt collectors, legal fees and Court costs.

8.3 Suspension of account: Jobs in Asbestos may suspend an Advertiser’s account and withdraw or refuse publication of all vacancy submissions where the Advertiser’s account is in arrears. Any fees for advertising under contract will continue to accrue during the period of suspension and remain payable, regardless of the volume of advertising published during the period.


9. Warranty and Indemnity

9.1 Advertiser warrants to Jobs in Asbestos in relation to each vacancy submission, that the vacancy details represent a genuine vacancy and that all information supplied is accurate complete and true in all respects and that the publication of the vacancy details and the reproduction of the whole (or a substantial part of) the text submitted will not breach any agreement or infringe or violate any copyright, trade mark or any other right of any person or render Jobs in Asbestos liable to any proceedings whatsoever.

9.2 Advertiser shall at all times keep Jobs in Asbestos fully and effectively indemnified against any liability which Jobs in Asbestos may suffer or incur as a result of publishing vacancy details, and against any claim for infringement of any intellectual property or other third party rights.


10. Liability

10.1 Due to the nature of the Internet, there may sometimes be delays or interruptions to our normal service for reasons beyond our control. Jobs in Asbestos shall not be held liable for any losses arising from such events, and advertising fees shall remain payable in full.

10.2 Jobs in Asbestos accept no responsibility for loss of copy, data or other materials which the Advertiser supplies to it. Advertiser shall be responsible for retaining in their possession sufficient quality and quantity of such materials for their purposes.

10.3 Under no circumstances shall Jobs in Asbestos be liable to Advertiser whether under this agreement or in tort (including negligence or breach of statutory duty) misrepresentation or otherwise howsoever for pure economic loss, losses incurred by any client of the Advertiser or any third party, loss of profits (whether categorised as direct or indirect), losses arising from business interruption, loss of business revenue, goodwill, anticipated savings, wasted management or staff time, loss or corruption of data or any other form of consequential loss.

10.4 Subject to the above Jobs in Asbestos’s total liability (whether in contract, tort or otherwise) under or in connection with the publication of vacancy submissions shall under no circumstances exceed 200% of the total fees (excluding any VAT duty sales or similar taxes) paid or payable by the Advertiser to Jobs in Asbestos during the six month period immediately preceding any claim.


11. Third parties

11.1 The agreement reached pursuant to these terms and conditions is personal to the parties hereto and the Advertiser may not without Jobs in Asbestos’s previous consent in writing assign the agreement evidenced by these terms and conditions in whole or in part.

11.2 A person who is not a party to this agreement has no right under the Contracts (Rights of Third Parties) Act 1999 to enforce any term of the arrangements pursuant to these terms and conditions but this does not affect any right or remedy of a third party which exists or is available apart from that Act.
